Reinstatement of a Previously Dismissed Ticket
The Department of Finance may change a dismissal and restore a ticket if the agency believes that the original ticket dismissal was obtained on the basis of an altered record, false testimony or other misrepresentation or misconduct.

If you have received a Notice of Hearing with an attached Statement in Support of Setting Aside Prior Dismissals, it is to notify you Finance is beginning the process of reinstatement determining whether the dismissals should be set aside and whether a guilty decision for the original charged violations should be given.

What Should You Do if You Receive a Notice of Hearing for a Reinstatement?

To Contest the Reinstatement
You may appear by yourself, with an attorney, or send a representative who is authorized, in writing, to speak on your behalf. At the hearing, you will have the chance to show why you are not guilty of the original charge(s).

You (or your representative) should be fully prepared to discuss the ticket(s) and the issues in question at the hearing. Adjournments for you to obtain an attorney or for your attorney to prepare may or may not be granted.

If you do not appear for the hearing at the time and place shown on the Notice (or at any time and place assigned, if the original date is rescheduled) it will not stop the prior dismissal of the ticket(s) and a judgment may be made against you on the violations, even if you are not there. The scheduled fines may be restored, and up to three times the scheduled fine and three times the additional penalties may be assessed.

Uncontested Reinstatement Hearing
You do not have to appear if you agree you were guilty on the original ticket.

You may send a letter or call the Fraud Investigation Unit to say you do not want to object to the allegations in the Notice of Hearing and do not plan to attend. You will receive a response telling you the full amount that you are now required to pay.
