Resolution with a Hearing

If you are not eligible or choose not to resolve your Notice of Violation (NOV) without a hearing, you must participate in a hearing at the Environmental Control Board (ECB). In some instances, the NOV may require a hearing, even if you are not contesting the violation.

The hearing is your opportunity to explain why you think ECB should dismiss your notice of violation. Hearings can be conducted in-person, or, in some instances, by mail. If you are not satisfied with the results of your hearing, you can appeal the Administrative Law Judge's (ALJ's) decision and order.
