In-Person Hearing

Every NOV includes a hearing date. If you do not resolve your NOV before the scheduled hearing date, you must appear at ECB on that date or reschedule your hearing. 

Rescheduling
If you cannot appear at ECB on your scheduled hearing date, call 311 or the office that is scheduled to hear your violation before the hearing date to reschedule. If you have missed your hearing date, you should contact ECB immediately for instructions on how to proceed with your NOV. 

Arriving for a Hearing
You will need to check in with the receptionist when you arrive at ECB. When you check in, you will be given a Notice of Appearance form. You will need to return the completed form, along with your NOV, to the receptionist. Afterward, you will need to wait until an ALJ calls you for your hearing.

Participating in a Hearing
An ALJ will call your name and direct you to a hearing room.  If you are accompanied by witnesses, they should go with you into the hearing room. 

Several individuals may be in the hearing room when you arrive.  There may be an agency representative in attendance who will speak for the petitioner agency.  Occasionally, the officer who wrote your NOV will be there to testify.  However, the NOV itself is evidence of the violation, so the officer's testimony may be unnecessary.

Once everyone is in the hearing room, the ALJ will introduce him or herself and will explain how ECB hearings are conducted.  Hearings are recorded.  The ALJ will take your testimony and that of anyone else testifying, such as the issuing officer or any witnesses you present.  The ALJ will also hear legal arguments from you and the petitioner agency's representative.

You will not receive a decision at the hearing.  ECB will mail the ALJ's written decision and order to you at a later date.  Depending on the violation, the decision and order may include a requirement for you to correct the violation and certify the correction.

In certain situations, your hearing may be adjourned and rescheduled for a later date.  Either you or the petitioner can ask for an adjournment in order to gather more evidence or so that the issuing officer or other witnesses can testify.  The ALJ may also decide to adjourn your hearing if s/he feels that the issuing officer's testimony is necessary.  All adjournments are granted at the discretion of the ALJ.  If your hearing is adjourned, you will need to return on another date to resolve your case.
